A federal judge has ruled against the Trump administration's plan to link counterterrorism funding to election security measures. This decision allows funding to continue without requiring states to implement specific voting reforms.
Judge Amir Ali, appointed by President Biden, ruled that the Federal Emergency Management Agency (FEMA) exceeded its authority by trying to impose election security requirements to access Homeland Security Grant Program funds.
The conditions included verifying voter citizenship, checking the citizenship status of poll workers, using hand-marked paper ballots, and conducting post-election manual audits.
The ruling came as a response to a lawsuit from local governments in Texas, Tennessee, and Ohio, including cities like Nashville and Harris County.
Judge Ali stated that Congress did not authorize FEMA to withhold funds for routine election administration matters and that the conditions imposed were not related to counterterrorism preparations or responses.
The decision marks a setback for efforts to enhance election security ahead of upcoming elections.
Under the previous plan, states would have faced a 20% holdback of grant funding until they complied with the outlined security changes, affecting hundreds of millions of dollars nationwide.
Despite the ruling, a requirement remains for at least 3% of the grant to be spent on physical and cyber election security.
The judge has a history of decisions favoring more liberal stances, including previous rulings on USAID funding.
The ruling is viewed as favorable to Democrat-led cities, allowing them to avoid implementing federal election security requirements linked to grant funding. This decision underscores ongoing legal disputes over election integrity initiatives and federal funding mechanisms in relation to election administration.
