Biggest Loser in DOJ History Takes a Final L on His Way Out the Door

 Special Counsel Jack Smith has dismissed his criminal indictment against President Trump related to January 6, marking another failure in his record at the Department of Justice (DOJ). Smith, who has faced continuous defeats in high-profile cases, previously lost a Supreme Court case regarding the bribery conviction of a former governor and failed to achieve convictions in other significant prosecutions. His dismissal of the indictment comes after the Supreme Court rebuked him on multiple occasions, particularly concerning presidential immunity.

Smith requested the dismissal “without prejudice,” implying that the indictment could be reconsidered later, which is based on past opinions regarding whether a sitting president can be prosecuted. He asserted that this decision is not indicative of the strength of the case against Trump. Judge Tanya S. Chutkan agreed to dismiss the indictment but suggested it could be revisited in the future, reinforcing Smith's stance that presidential immunity is temporary.

In addition, Smith also filed a closing brief in the classified documents case, which was previously dismissed by Judge Aileen Cannon. While he abandoned the appeal against Trump, he retained charges against two co-defendants. Republican lawmakers expressed joy over Smith's setback, condemning the indictment as politically motivated and indicative of a misuse of legal power.

Calls have been made for Republicans to leverage their political power to investigate the actions of Smith and his team, particularly regarding possible conspiracy charges related to the classified documents case and the handling of evidence. The hope is that this social media condemnation will lead to actions for accountability.
