A Texas judge has declared the state's ban on drag shows unconstitutional due to its vague language. This ruling marks the second time a federal court has struck down this ban.
Judge David Hittner ruled against S.B. 12, which aimed to ban drag shows and similar performances.
The judge stated that the law was "unconstitutionally vague" because it does not clearly define what is prohibited, particularly the term "prurient interest in sex."
He noted that the term lacks meaning in Texas law and its broad application could include many non-obscene performances.
Hittner provided examples of well-known entertainers, such as Dolly Parton and Miley Cyrus, who could be unfairly penalized under the law.
He emphasized that many performances contain elements that could be deemed "erotic" and thus subject to penalties.
Finally, Hittner advised those who are offended by such performances to simply avoid attending them.
The ruling reinforces the importance of clear legal definitions and protects artistic expression in entertainment, while offering a straightforward solution for those who disapprove of such performances.
