A Win for Girls’ Sports—and Common Sense

The Supreme Court recently ruled on the issue of whether schools can limit women's and girls' sports to those who are biologically female. The Court stated that schools have the right to restrict athletic teams to biological females, affirming the importance of fair competition in sports.

1. Background of the Case: The ruling stemmed from two cases, West Virginia v. B. P. J. and Little v. Hecox, involving laws in West Virginia and Idaho that prohibited males from participating in female sports. The states argued that female-only teams ensure equal opportunities, competitive fairness, and safety.

2. Supreme Court's Opinion: Justice Brett Kavanaugh confirmed, under Title IX and the Equal Protection Clause, that schools can indeed limit women's sports to biological females. This decision was influenced by the necessity to uphold equal opportunities in athletics.

3. Challengers' Arguments: The plaintiffs, including a male student who identifies as female, contended that the laws discriminated based on transgender status. They suggested a case-by-case assessment could determine if transgender athletes have an unfair advantage.
