SCOTUS Likely To Revive Obama-Era Practice Of Turning Away Asylum-Seekers

The U. S. Supreme Court will reconsider an immigration policy that rejected asylum seekers at southern border ports. This review comes after President Trump requested it, challenging a previous Ninth Circuit ruling that deemed the policy illegal.

The Biden administration discontinued the practice, known as “metering. ” However, Trump’s legal team argues that the ruling undermines Congress's authority over asylum policy. Al Otro Lado, an immigrant rights group, and asylum-seekers involved in the original lawsuit support the Ninth Circuit's decision and are ready to defend it at the Supreme Court.

Questions remain regarding the future of this policy, with the Justice Department not commenting on the Supreme Court's upcoming review. The Immigration and Nationality Act states individuals seeking asylum can do so regardless of their location in the U. S.
