In 2021, a South Carolina citizen submitted a routine Freedom of Information Act (FOIA) request to the South Carolina Election Commission (SCEC) seeking the cast vote records (CVRs) from the 2020 general election.
These digital records created automatically by voting systems reflect how every ballot was counted, line by line. Crucially, they contain no personal identifiers whatsoever. They do not link to voter names, registration numbers, or physical ballots.
Yet the SCEC rejected the request, claiming the records would disclose voter ID and violate ballot secrecy.
