The Rise and Fall of the American Bar Association

The American Bar Association (ABA) is experiencing a significant decline in membership and influence, prompting various states, particularly Texas, to look for alternatives in bar admissions and legal education. This shift highlights concerns regarding the ABA's impact on the legal profession, competition in legal education, and its evolving political stance.

• FTC Letter to Texas Supreme Court: The Federal Trade Commission (FTC) sent a letter to the Texas Supreme Court discussing the ABA's role in bar admissions and suggesting it operates as a monopoly. The Texas justices are considering proposals that would allow alternatives to ABA accreditation for law school graduates.

• Changing Perceptions of the ABA: Originally established in 1878 to advance legal standards and the practice of law, the ABA has shifted leftwards over the decades, becoming an organization known for its advocacy rather than neutrality. This change has alienated many members and legal professionals.

• Membership Decline: The ABA's membership has plummeted from about 650,000 in 2015 to 227,000 today, representing only 17% of the legal profession. This mirrors trends seen in other professional organizations, such as the American Medical Association, which has seen similar decreases.

• Activist Influence: The ABA has increasingly embraced political agendas, particularly by taking firm stances on social issues. For instance, the organization has made controversial pronouncements on abortion and transgender rights, further alienating members who may have differing views.

• Impact on Legal Education: The relationship between the ABA and law schools has also become problematic, with critics arguing that this back-and-forth has led to irrelevance in the eyes of the public.

• Perception vs. Reality: Despite its dwindling representation, the ABA continues to be viewed as the voice of the legal profession, perpetuated by political and media allies. Critics encourage recognizing the organization's diminished relevance and the need for competition within the legal field.

• Potential for Change: The ongoing discussion in Texas regarding bar admissions opens the door for alternatives to the ABA, potentially leading to a return to the association's foundational mission of promoting justice and professionalism without political bias.

The ABA's transformation from a professional standards organization to one engulfed in political activism has led to a significant drop in membership and faith among legal professionals. As states consider alternative routes for bar admissions, the ABA's future and its role within the legal community are uncertain. The hope remains that the ABA can revert to its origins, focusing on enhancing justice and the legal profession.
