House Republicans are exploring legal ways to stop New York City mayoral-elect Zohran Mamdani from taking office, referring to the Constitution's "insurrection clause. " This clause, from Section 3 of the 14th Amendment, bars anyone who has engaged in rebellion or supported enemies of the U. S. from holding public office.
The New York Young Republican Club is leading this effort, arguing that Mamdani’s past support for resisting ICE and his connections to leftist groups may qualify as providing aid to enemies. They seek to either remove him from the ballot or invalidate his election if he wins.
Following next week's election, some Republicans may push for a vote to declare Mamdani ineligible based on this clause, although this faces legal hurdles, including potential opposition in the Senate. Additionally, there are efforts urging the Justice Department to investigate Mamdani’s citizenship, claiming he may have violated his naturalization oath.
