North Dakota Supreme Court Upholds Abortion Ban

On November 22, 2025, the North Dakota Supreme Court upheld a nearly total ban on abortions, marking a significant win for pro-life advocates in the state.

• Supreme Court Ruling: In a close 3-2 decision, the court ruled that the pro-life law, enacted in 2023, is constitutional, contrary to a lower court's decision that had deemed it unconstitutional.

• Senate Bill 2150: This law classifies performing an abortion as a felony, carrying penalties of up to five years in prison and a $10,000 fine. It allows abortions only when necessary to save a patient’s life or health, and these must take place in hospitals.

• Support from Officials: Attorney General Drew Wrigley and State Senator Janne Myrdal expressed support for the ruling, framing it as a reflection of the people's values in North Dakota.

• Previous Legal Challenges: The legal controversy began when the Red River Women’s Clinic challenged the law. A district judge previously ruled it unconstitutional, arguing it violated women’s rights and was poorly tailored.

• Appeal Process: The state appealed the ruling, arguing for its long-standing interest in protecting life. The Supreme Court's recent ruling has immediate effects, reinstating the ban and making almost all abortions illegal in North Dakota.

With this ruling, North Dakota reinforces strict abortion regulations, effectively eliminating access to the procedure within the state since the closure of the last surgical abortion clinic in 2022.
