The Biden-Harris administration has paroled over 2 million migrants into the U. S. , often violating parole statutes. Interestingly, while many legally admitted aliens cannot possess firearms, those on parole can, despite not being properly screened. Parole, under section 212(d)(5)(A) of the Immigration and Nationality Act, allows certain aliens to enter the U. S. briefly for urgent humanitarian reasons, but they retain a legal status akin to those still waiting at the border. Consequently, they have limited rights, including minimal Fifth Amendment protections.
Federal law prohibits firearm possession by certain aliens, as stated in 18 U. S. C. § 922(g)(5), but it does not apply to parolees. Definitions of who is unlawfully in the U. S. by the ATF exclude paroled individuals, creating a loophole. While nonimmigrant aliens often cannot possess firearms, the unique status of parolees allows them this access. This issue arose when the number of paroled individuals surged, with over 320,000 paroled in FY 2022 and many more in FY 2024. Most were from Cuba, Haiti, Nicaragua, and Venezuela, due to new parole programs.
Concerns have emerged over these programs being vulnerable to fraud, and reports of parolees committing serious crimes have surfaced. The administration has been vocal about closing background check loopholes to prevent criminals from obtaining firearms. However, allowing unscreened parolees access to guns poses significant risks, as many may be criminals or terrorists who quickly seek firearms. The combination of these policies has resulted in significant security and safety concerns.
